Door Open For Internet Gambling in EU

The European Union is finally taking some action against countries that are trying to ban online gambling. Last Friday, EU Industry Commissioner Guenter Verheugen wrote to German regional state governments giving them a month to change a draft treaty on the issue, in which they are trying to ban online gambling.
"We asked Germany to reconsider the total ban on lottery and sports betting on the Internet. We think a proposed total ban is disproportionate and there are less restrictive measures, such as mandatory prior registration and strict guarantees on identification," a European Union Commission official said on Friday about the situation.
Countries like Germany and France are trying to put some pressure on online gambling by trying to create laws to ban all online gambling forms, in order to protect their state owned gambling monopolies. In fact, it has been argued that this ban is against the free trade rule, one of the most important EU rules. France and Germany have been able to collect large revenues from their gambling monopolies, and don’t want any competition. Companies like BWIN (www.bwin.com) and countries like UK and Austria are challenging France and German gambling ban desires, arguing that this is a form of protectionism. Spain and Italy are also trying to regulate gambling instead of banning it.
The European Commission avoided making any ruling against a member state, but that situation is going to change soon. The intervention of EU Industry Commissioner Guenter Verheugen against Germany is a clear sign that EU sees any gambling ban as a protectionism practice and will not tolerate it. Countries like UK, Austria, Spain and Italy, have been working in order to accept this fact and to try to regulate the industry. France, Germany, and Holland are just trying to keep their monopolies as long as possible instead of trying to create a legal environment for the industry.
The EU is heading to the opposite side US has chosen when the UIGEA was passed, and is also trying to put some pressure to it by supporting the WTO ruling against the US.
With all these developments in the EU, the WTO ruling, Barney Frank repeal against UIGEA, the announcement of Louisiana dropping all warrants against online gambling operators, and the postponement of Neteller case, it seems that the door will be opened again for online gambling.
